Terms of Service

By using the Hatchnetwork.com web site (“Hatch”, “Hatch Network” or the “Site”), a service of Hatch Network, LLC, you (the “user”, “member”, or “you”) agree to be bound by the following terms and conditions (the “Terms of Use” or the “Agreement”).

Before you may become a member of the Hatch Network, or apply for EBO certification, you must read and accept all the terms and conditions in the Agreement. The Agreement is effective upon acceptance for new users.

Membership Eligibility

Age: Hatch Network services are available only to, and may only be used by, individuals who are 21 years and older who can form legally binding contracts under applicable law.

Password: Keep your password secure. You are fully responsible for all activity, liability and damage resulting from your failure to maintain password confidentiality. You agree to immediately notify Hatch Network of any unauthorized use of your password or any breach of security. You also agree that Hatch Network cannot and will not be liable for any loss or damage arising from your failure to keep your password secure.You must have a valid credit card on file with Hatch Network at all times.

Right to Refuse Service: Hatch Network services are not available to temporarily or indefinitely suspended members. We reserve the right, at our sole discretion, to cancel unconfirmed or inactive accounts. Hatch Network reserves the right to refuse service to anyone, for any reason, at any time.

Termination: Hatch Network may terminate your membership, delete your profile and any content or information that you have posted on the site with or without notice, at its discretion, for any reason, or no reason.

Member Conduct

Hatch Network has a zero-tolerance policy for members who violate our terms of use. You are solely responsible for your conduct and activities on the site, and any and all data, text, information, usernames, graphics, images, photographs, profiles, audio, video, items, links, and other content that you submit, post, and display on Hatch Network.

Unacceptable behaviors include:

• unauthorized solicitation, advertising, spam, solicitations or other intrusive or excessive promotional attempts
• solicitation or recruiting for multi-level marketing programs
• posting abusive, harassing, vulgar, obscene, or otherwise objectionable language or content
• falsely representing yourself, or posting inaccurate or misleading information
• using any code of a destructive nature that may damage interfere with, intercept or expropriate any system, data or personal information
• violating or infringing upon the rights of any third party, including copyright, trademark, privacy, publicity, trade secret or other personal or proprietary rights; or postings that are libelous, defamatory or otherwise unlawful

Payment terms and conditions

We accept Visa and MasterCard,credit cards and checks, as forms of payment. By submitting an order to Hatch Network, you authorize Hatch Network, or its designated payment processor, to charge the account you specify for the purchase amount. All payments are to be made in United States Dollars. When you provide your credit card number to Hatch Network, you may authorize us to store your credit card number and related payment information.

Privacy

Except as outlined in Hatch Network’s Privacy Policy, Hatch Network will not sell or disclose your personal information to third parties without your explicit consent.

Third Party Websites and Content

The Hatch Network website may contain links to other web sites (“Third Party Sites”) as well as articles, photographs, text, graphics, pictures, designs, music, sound, video, information, applications, software and other content or items belonging to or originating from third parties. Such Third Party Sites are not investigated, monitored or checked for accuracy, appropriateness, or completeness by us, and we are not responsible for any Third Party Sites accessed or otherwise utilized through the Site. Inclusion of, or linking to any Third Party Site does not imply approval or endorsement thereof by us. If you decide to leave the Site and access the Third Party Sites, you do so at your own risk and are subject to abiding by the terms and policies of the Third Party Site, as our terms and policies will no longer be in effect.

Fees and Termination

If Hatch Network terminates your membership, if you cancel your membership, or if the payment of your Hatch Network fees cannot be completed for any reason, you remain obligated to pay the Company for all unpaid fees plus any penalties, if applicable.

Refund or cancellation policy

Membership fees are non-refundable, and paid annually, with the potential for an annual increase. Membership fees are no longer required after four years of payment, but the member must still pass the EBO quiz annually.

Appearance Release for Photography and Video

Hatch Network (the Producers) may tape and photograph you, and record your voice, conversations and sounds, including any performance, during and in connection with your participation and that the producers shall be the exclusive owner of the results of such taping, photography and recording with the right throughout the world, an unlimited number of times in perpetuity, to copyright, to use and to license other’s to use, in any manner.

As a Hatch Network member, you hereby consent for value received and without further consideration or compensation to the use (full or in part) of all recorded video or photos taken of you and/or recordings made of your voice and/or written extraction, in whole or in part, of such recordings for the purposes of illustration, broadcast, or distribution in any manner.

Indemnity

You agree to indemnify and hold Hatch Network, its subsidiaries and affiliates, and each of their directors, officers, agents, contractors, partners and employees, harmless from and against any loss, liability, claim, demand, damages, costs and expenses, including reasonable attorney’s fees, arising out of or in connection with your use of the site or the Hatch programs.
